Terms of Service
Effective: October 30, 2026
These Terms of Service ("Terms") are a contract between Streamline SMB, LLC, a Florida limited liability company that provides Wow Menu Boards ("we," "us," or "our"), and the business that uses Wow Menu Boards ("you" or "Customer"). Please read them carefully. We kept them as plain as we could.
1. Agreeing to these Terms
By creating an account, installing our apps, connecting a screen, or otherwise using Wow Menu Boards, you agree to these Terms, our Privacy Policy, and, for our TV and app-marketplace apps, our End User License Agreement.
You may use Wow Menu Boards only for business purposes. If you accept these Terms for a company or other business, you promise that you have the authority to bind that business. If you do not agree, do not use the Service.
2. What these words mean
- "Service" means Wow Menu Boards, including our websites (wowmenuboards.com and wowmenuboards.app), the Wow Menu Boards Player app for Fire TV and Android TV (the "TV App"), the web dashboard when available (the "Dashboard"), and related features and support.
- "Your Content" means the images, videos, text, menus, prices, and other material you upload, create, or connect to show on your screens.
- "Screen" means a TV or display that runs the TV App and is linked to your account.
- "Third-Party Services" means services we don't own that you choose to connect or use with the Service, such as Clover, Square, Toast, Google, Instagram, Facebook, TikTok, Telegram, Stripe, and Amazon.
3. Who can use the Service
You must be at least 18 years old and using the Service for a business. The Service is not intended for personal, family, or household use.
4. Your account
Some features require a Dashboard account. When you use them:
- Give us accurate information and keep it up to date.
- Keep your password, sign-in links, and screen codes private. Anyone with a screen code may be able to link a TV to your screen.
- You are responsible for everything that happens in your account, including what your staff users do. You choose who to invite and what role each person has.
- Tell us right away through the contact form at wowmenuboards.com/contact if you think someone has used your account without permission.
5. Your Content
You own Your Content. We do not claim ownership of it.
To run the Service, you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, resize, convert, cache, send, and display Your Content, only to provide the Service to you, to keep it secure, and as you direct (for example, to show it on your screens). This license ends when you delete Your Content or your account closes, except that copies may remain for a limited time in backups and in the cache on your TVs until they are replaced or cleared, as described in our Privacy Policy.
You promise that you have all the rights and permissions needed for Your Content, including rights to any music, photos, logos, trademarks, and images of people in it.
If you send us ideas or feedback, we may use them to improve the Service without owing you anything.
6. You are responsible for what your screens show
We display what you set up. We do not review Your Content or check it for accuracy. You are responsible for making sure everything on your screens is accurate, up to date, and legal, including:
- prices, item names, descriptions, specials, and promotions;
- allergen information and warnings;
- nutrition and calorie information, including any menu-labeling rules that apply to your business;
- any required notices about alcohol, tobacco, or other age-restricted items; and
- any other legal requirements for your business and location.
Check your screens regularly, especially after you change prices or menus, or after a Screen has been offline.
7. Acceptable use
You agree not to use the Service to:
- show anything unlawful, false or misleading, defamatory, obscene, hateful, or harassing;
- show content that infringes anyone's copyright, trademark, privacy, or other rights;
- upload viruses or harmful code, or try to break into, overload, or disrupt the Service or our servers;
- get around security, limits, or screen-count rules, or access other customers' accounts or data;
- copy, resell, or rent the Service to others without our written permission; or
- break any law or any Third-Party Service's rules.
We may remove content or suspend access if we reasonably believe you are breaking this section. When we can, we will tell you first and give you a chance to fix it.
8. POS and other Third-Party Services
These features apply when you use them.
- Your choice. You choose whether to connect a POS system (like Clover, Square, or Toast) or another Third-Party Service. By connecting one, you allow us to access the data described in our Privacy Policy for that service, only to provide the Service to you.
- Their terms apply. Your use of each Third-Party Service is governed by your agreement with that provider, not by these Terms.
- Prices come from your POS. When your screens show menu items, prices, or availability from your POS, that information comes from your POS system. You are responsible for checking that it is correct. If your POS has wrong data, your screens may show wrong data.
- We don't control them. We are not responsible for outages, delays, errors, data mistakes, or changes in any Third-Party Service. If a provider changes or shuts down its system or our access, we may need to change or stop that integration. If that happens, we will tell you as soon as we reasonably can.
- Disconnecting. You can disconnect a Third-Party Service at any time. We then delete the data we copied from it as described in our Privacy Policy.
9. Data and privacy
Our Privacy Policy explains how we handle information. For personal information that is part of Your Content or that we receive from your POS or other connected services, we act as your service provider: we use it only to provide the Service to you, we do not sell it or share it for targeted advertising, and we will reasonably help you respond to privacy requests about it. You are responsible for having the rights and giving any notices needed for personal information in Your Content (for example, photos of your staff in a menu video).
10. TV App and hardware
The TV App is covered by our End User License Agreement. Hardware is not included unless we agree otherwise in writing. You are responsible for your TVs, Fire TV and Android TV devices, mounts, power, internet service, and their setup, and for following the terms of the app store where you got the TV App.
11. Availability and support
- No uptime guarantee. We work hard to keep the Service running, but we do not promise it will always be available or error-free, unless we sign a separate service level agreement (SLA) with you.
- Maintenance. We may need to pause the Service for updates or repairs. We try to do this at quiet times and give notice for planned work when we can.
- Offline screens. If a Screen loses its internet connection, the TV App may keep showing the content it last saved, which may be out of date (for example, old prices or items). It may also show nothing. It will update when it reconnects.
- Changes. We may add, change, or remove features. If we remove a major paid feature you rely on, we will give you reasonable notice.
- Support. We provide support through the contact form at wowmenuboards.com/contact during Monday to Friday, 9 a.m. to 5 p.m. Eastern Time.
12. Fees, billing, and renewal
- Plans and prices. Prices are shown when you sign up or in your order.
- Billed in advance. Subscriptions are billed in advance for each billing period (monthly or yearly, as you choose) and renew automatically until you cancel.
- Payment. You authorize us (through our payment processor, Stripe) to charge your payment method for each period. If you subscribe through an app marketplace like the Clover App Market, that marketplace may bill you instead, and its billing rules also apply.
- Taxes. Prices do not include sales or similar taxes, which you are responsible for.
- Price changes. We will give you at least 30 days notice before a price increase takes effect. If you don't want the new price, you can cancel before it starts.
- Late or failed payments. If a payment fails, we will let you know. If it is not fixed within 14 days, we may pause the Service until it is.
- Billing errors. If you think we charged you wrongly, tell us within 60 days and we will look into it right away.
13. Free trials
If we offer a free trial, its length and whether a payment method is needed are shown when you sign up. If a payment method is required, your paid subscription starts automatically when the trial ends unless you cancel before then. We will remind you before the trial ends at least 3 days. We may change or end trial offers at any time, but changes will not affect a trial you have already started.
14. Cancellation and refunds
- Cancel anytime. You can cancel at any time from your Dashboard or by contacting us through the contact form. Cancellation takes effect at the end of your current billing period, and you keep access until then.
- Partial periods. We generally do not refund partial billing periods.
- But we want to be fair. If something isn't working, contact us — we'll make it right. We may offer a prorated refund or account credit at our discretion, and we will review every request honestly.
- If we end the Service. If we stop providing the Service or end your account for a reason that is not your fault, we will refund the unused, prepaid part of your fees.
15. Our property
We (and our licensors) own the Service, including the software, design, and the Wow Menu Boards name and logo. These Terms do not give you any rights to them except the right to use the Service as these Terms allow.
16. Suspension and termination
- By you. You may stop using the Service and cancel at any time (see Section 14).
- By us. We may suspend or end your access if you seriously or repeatedly break these Terms, don't pay, put the Service or others at risk, or if the law requires it. When reasonable, we will give you notice and a chance to fix the problem first. We may also end the Service for everyone with at least 30 days notice.
- After it ends. Your access stops and your TV App screens will no longer receive updates. You can download Your Content for 30 days after your account ends. After that, we delete your data as described in our Privacy Policy.
- What survives. Sections that by their nature should continue (such as fees owed, Your Content license limits, disclaimers, limits of liability, indemnity, and governing law) continue after these Terms end.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT INFORMATION SHOWN ON YOUR SCREENS (INCLUDING PRICES OR AVAILABILITY FROM THIRD-PARTY SERVICES) WILL BE ACCURATE OR CURRENT.
18. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF TOLD THEY WERE POSSIBLE.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT BE MORE THAN THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT CAUSED THE CLAIM.
These limits do not apply to your payment obligations, your indemnity duties in Section 19, or to anything the law does not allow us to limit.
19. Indemnity
You will defend, indemnify, and hold harmless Streamline SMB, LLC and its owners, employees, and agents from any third-party claims, losses, and costs (including reasonable attorneys' fees) that come from: (a) Your Content or anything shown on your screens, including prices, allergen, and nutrition information; (b) your use of the Service or Third-Party Services; (c) your breach of these Terms; or (d) your violation of any law or anyone else's rights. We will tell you promptly about any such claim and reasonably cooperate, at your cost.
20. Governing law and disputes
- Talk to us first. If you have a problem, please contact us first. We will try in good faith to solve it within 30 days.
- Florida law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
- Where. Any lawsuit about these Terms or the Service must be brought in the state or federal courts located in Broward County, Florida, and both parties agree to those courts' jurisdiction.
21. Changes to these Terms
We may update these Terms from time to time. We will post the new version here and change the "Effective" date. For important changes, we will give you at least 30 days notice by email or in the Dashboard before they take effect. If you don't agree with the changes, you may cancel before they take effect. If you keep using the Service after that, you accept the new Terms.
22. General
- Entire agreement. These Terms, the Privacy Policy, the EULA, and any order form or SLA we sign with you are the whole agreement between us. If a signed order form or SLA conflicts with these Terms, the signed document wins.
- Severability. If part of these Terms can't be enforced, the rest still applies.
- No waiver. If we don't enforce a right right away, we have not given it up.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, sale, or reorganization, with notice to you.
- Events beyond control. Neither party is responsible for delays caused by events beyond its reasonable control, like power or internet outages, natural disasters, or failures of Third-Party Services.
- Electronic notices. We may send notices by email or in the Dashboard. You can send notices through the contact form at wowmenuboards.com/contact.
- Independent parties. We are independent businesses. These Terms do not create a partnership, joint venture, or employment relationship.
